Terms of Service

These Terms of Service ("Terms") govern your use of the HomeBite mobile application and services (the "Service") operated by N IT Services ("we", "us", "our"). By using the Service, you agree to these Terms.

1. About the Service

HomeBite is a community marketplace that connects residents ("Customers") with home chefs ("Home Chefs") in the same gated community or neighbourhood, enabling Customers to order home-cooked meals. HomeBite is a facilitator; the food itself is prepared and delivered by the Home Chef.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use the Service.

3. Accounts

• You are responsible for keeping your login credentials secure.
• You must provide accurate information and keep it up to date.
• You may not share your account with others or create multiple accounts to abuse the Service.

4. Orders and payments

• Placing an order is an offer to purchase, which the Home Chef may accept or reject within a defined deadline.
• If the Home Chef does not accept within the deadline, your order is auto-cancelled and refunded in full.
• Prices are set by individual Home Chefs and displayed inclusive of applicable taxes.
• Payments are processed by Razorpay. By placing an order, you authorise the charge to your chosen payment method.
• HomeBite is not a party to the sale contract between Customer and Home Chef; it acts only as a facilitator and payment processor interface.

5. Home chef responsibilities

• Home Chefs are responsible for the quality, safety, hygiene, and accurate description of the food they sell.
• Home Chefs must comply with all applicable food safety laws (including FSSAI requirements where applicable).
• Home Chefs agree to honour accepted orders and deliver within reasonable time.

6. Customer responsibilities

• Provide accurate delivery details within the community.
• Be available to receive the order at the agreed time and location.
• Treat Home Chefs with respect and courtesy.

7. Prohibited use

You may not use the Service to: (a) sell alcohol, tobacco, or controlled substances; (b) violate any law; (c) harass, threaten, or defraud other users; (d) upload malicious code; (e) reverse-engineer or copy the Service.

8. Content

You retain ownership of content you post (dish photos, reviews, feed posts) but grant HomeBite a non-exclusive, royalty-free licence to display it within the Service. We may remove content that violates these Terms.

9. Disclaimers

The Service is provided "as is" without warranty of any kind. HomeBite does not guarantee the quality, safety, or legality of meals provided by Home Chefs. We are not liable for food-related illness, allergic reactions, delivery delays, or disputes between Customer and Home Chef, except to the extent required by applicable law.

10. Limitation of liability

To the maximum extent permitted by law, HomeBite's total liability for any claim arising from the Service is limited to the amount of the specific order giving rise to the claim.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may close your account at any time by contacting us.

12. Governing law

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana.

13. Changes

We may update these Terms at any time. Continued use of the Service after changes means you accept the revised Terms.
